Model Policy on Referral of Sexual Abuse Allegations for Investigation



The (agency) will insure that investigations are conducted on all reports of sexual abuse and sexual harassment. It is the agency's policy to refer all sexual abuse reports to an outside law enforcement agency. Agreements will be maintained with investigating authorities specific to the investigation of sexual abuse in the facility. These agreements will contain: (1) criteria, protocol and timetables for referring an allegation of sexual abuse for investigation; (2) the roles and responsibilities for collecting evidence and conducting the investigation; (3) detailed information for how investigations will be coordinated between the agencies; (4) description of information that will and will not be shared; (5) the protocol for reporting investigation progress to the facility; (6) protocol for informing the victim of investigation progress; (7) plans for regularly scheduled reviews. Investigating agencies will have training in the area of sexual abuse.

Agreements will be maintained with prosecuting authorities. The agreements will contain: (1) the purpose of the agreement; (2) identification of a liaison position within the agency; (3) objective criteria for referral; (4) time frames for submission of criminal cases, (5) protocol for prosecutors to report back to the facility after case review, (6) roles and responsibilities of the facility and prosecuting agency, (7) schedule of regular review meetings.

The agency makes this policy available to the public, maintains copies of relevant agreements, and documents all referrals for investigation.
